Kezabu Care respects your privacy and is committed to handling personal information with care, dignity and transparency. This policy explains how we collect, hold, use and disclose personal information in connection with our enquiries and disability support services.
We manage personal information in accordance with applicable Australian privacy requirements, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), where they apply to us. As a registered NDIS provider, we also follow relevant NDIS obligations concerning participant privacy, dignity, confidentiality and information management.
The information we collect depends on your relationship with Kezabu Care. It may include:
Where practical, we collect information directly from you. We may also receive information from someone you have authorised to act or communicate on your behalf, such as a family member, nominee, support coordinator or plan manager. We may collect information from another person or organisation where this is authorised by you, required by law, or reasonably necessary for us to provide safe and appropriate services.
We collect, use and disclose personal information only for purposes connected with our work and legal responsibilities. These may include:
We do not sell your personal information. We do not use sensitive participant information for unrelated marketing.
We aim to explain what information we need and why we need it in a way that is easy to understand. Where consent is required, we seek it before collecting, using or sharing information. You may withdraw consent for an optional use or disclosure, although this may affect our ability to provide a particular service where the information is necessary for that service.
Where it is practical and lawful, you may make a general enquiry without identifying yourself or by using a pseudonym. We will need enough accurate identifying information when it is necessary to establish or provide NDIS supports, meet safety requirements, process payments or comply with the law.
We may share relevant information with people or organisations involved in providing or administering your supports, but only where there is a lawful basis to do so. Depending on the circumstances, this may include your nominee, family member, support coordinator, plan manager, health or emergency services, professional advisers, insurers, service providers, or government and regulatory bodies such as the NDIS Quality and Safeguards Commission.
We may also disclose information where required or authorised by law, or where necessary to respond to a serious threat to health or safety.
Personal information may be held in electronic systems and, where necessary, in paper records. We take reasonable steps to protect information from misuse, interference, loss, unauthorised access, modification or disclosure. Access is limited to people who need the information for legitimate work purposes.
We retain records for as long as required for service, legal and regulatory purposes and securely destroy or de-identify information when it is no longer required, where the law permits us to do so.
Some technology, email, website or cloud service providers we use may operate infrastructure or process information outside Australia. The countries involved can depend on the provider and its systems. Where personal information is disclosed to an overseas recipient, we will take reasonable steps required by applicable privacy law to protect that information. You can contact us if you would like more information about the service providers relevant to your information.
You may ask to access personal information we hold about you or request that inaccurate, out-of-date, incomplete, irrelevant or misleading information be corrected. Contact us by email or phone using the details below. We will respond within a reasonable period and, if we cannot provide access or make a requested correction, we will explain why where required by law.
If you are concerned about how Kezabu Care has handled your personal information, please contact us first so we can look into the matter. We will acknowledge your concern, consider the issues raised, and respond within a reasonable timeframe. Raising a privacy concern will not affect your right to receive safe and respectful supports.
If you are not satisfied with our response, you may be able to contact the Office of the Australian Information Commissioner (OAIC) or, where the matter relates to NDIS supports or services, the NDIS Quality and Safeguards Commission.
